Welcome to Ecomfyre.com. By using this website, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.

1. Services Provided

Ecom Fyre offers:

  • Digital marketing (ads, SEO, social media management)

  • E-commerce development (Shopify, Salla, WordPress)

  • Consulting and audits
    Specific deliverables will be outlined in individual contracts or proposals.

2. Client Responsibilities

You agree to:

  • Provide accurate business information, assets (logos, ad accounts), and access needed for service delivery.

  • Make timely payments (see Section 4).

  • Not hold Ecom Fyre liable for platform changes (e.g., Meta/Google algorithm updates) beyond our control.

3. Fees & Payment

  • Fees are outlined in proposals/invoices. Recurring services (e.g., ad management) are billed monthly.

  • Late payments (>7 days) incur a 1 % fee or may pause services.

  • Refund Policy: Retainers and prepaid services are non-refundable unless otherwise stated in writing.

4. Intellectual Property

  • You own: Content you provide (product images, brand assets).

  • We own: Campaign strategies, ad creatives, and reports we generate (unless otherwise agreed in writing).

  • Upon full payment, we grant you a license to use deliverables for your business.

5. Confidentiality

Both parties agree to keep sensitive information (business strategies, ad spend, etc.) confidential unless required by law.

6. No Liability; Full Disclaimer

Ecom Fyre and its affiliates shall not be liable for any:

  1. Direct/Indirect Damages: Including but not limited to lost profits, revenue, data, or business opportunities.

  2. Third-Party Issues:

    • Ad platform suspensions (Meta/Google/TikTok bans)

    • Payment processor failures (Stripe/PayPal disputes)

    • Hosting/SaaS outages (Shopify, WordPress errors)

  3. Uncontrollable Events: Algorithm changes, economic shifts, or force majeure (natural disasters, wars).

  4. Client Actions: Misuse of strategies, delayed approvals, or provision of inaccurate data.

Maximum Liability Cap: If any liability is imposed despite this clause, it shall not exceed the fees paid to Ecom Fyre in the past 3 months.

7. No Guarantees

All services are provided “as is.” Ecom Fyre does not guarantee:

  • Specific ROAS/ROI results

  • Platform compliance (client is responsible for their store/ads)

  • Market performance (industry trends vary)

8. Absolute Limitation of Liability

Ecom Fyre expressly disclaims all liability, without exception, for:

  1. All Legal Matters

    • Any claims, lawsuits, or regulatory actions arising from client’s use of our services.

    • Violations of platform terms (Meta/Google/Shopify policies) by client.

    • Intellectual property disputes (copyright/trademark issues with client materials).

  2. No Dispute Resolution

    • Client waives all rights to pursue legal action, arbitration, or mediation.

    • No refunds or compensation will be granted under any circumstances.

  3. Full Client Responsibility

    • Client assumes 100% liability for:

      • Ad account bans/suspensions

      • Financial losses from implemented strategies

      • Compliance with local/international laws

This clause survives termination of services.

9. No Recourse Agreement

By using Ecom Fyre’s services, client irrevocably agrees:
✔ To never initiate legal proceedings against Ecom Fyre
✔ That all services are provided “as-is” with zero warranties
✔ To indemnify Ecom Fyre for any third-party claims

10. General

  • These Terms supersede prior agreements.

  • If any provision is unenforceable, the rest remain valid.

  • We may update these Terms; changes will be posted here.

11. Affiliate Links & Disclaimer

  • Some of the links on this Site are affiliate links. This means that if you click on an affiliate link and make a purchase, Ecomfyre may earn a commission — at no extra cost to you.
  • We only recommend products or services that we believe are useful, or that we have had positive experiences with, or that we feel may add value to our readers.
